Some OPII Property Rules
Do Not Attempt to Contact Board Members at their Private Residence. Threats or hostile actions against a board member or any member of the community will result in legal actions, fines or criminal charges. Any attempt to intimidate or threaten a sitting board member will result in a minimum of $500 fine.
No Rentals or Leases.
No investors. No Renters
Homeowners only.
Do not accept a lease or rental contract on an Orchard Park II property.
All rentals/leases must be approved by the HOA Board of Directors.
No new leases or rentals are being approved at this time. You may lose your down payment and be required to move from the property before the unauthorized lease ends, if you are not authorized to rent by the OPII Board.
If you are unsure about your current lease, contact the OPII Board to confirm permission.
Parking on OPII Property for OPII Homeowners, enforced by parking permits and towing. Proof of residency required.
If you purchase a OPII property, you are required to sign a Residency Affidavit. The Property Owner Must Occupy the Property. Fines start at $2,500.00 and can increase.
Family and friends cannot live on the property in place of the homeowner.
Warning: Do not let anyone trick you into purchasing an OPII Unit as an investor for the purposes of renting. We research. We fine. We pursue civil lawsuits against violators and we will lien your property. We will tow unauthorized vehicles. We will not allow our units to be used as rentals in violation of the declarations.
Lease to Own/ Lease Purchases or month to month are not allowed. Family members cannot stand in for the homeowner. No leases for more than one year at a time are approved.
The Fine for violating the OPII Rental Policy is $2,500.00 per year and subject to increase upon vote of the OPII Executive Board.
Noise Violation Policy
No Dumping
$500.00 Fine for Items left on the ground.
This includes regular trash, furniture, appliances, auto parts and other household items.
Break down large cardboard boxes and put them in the dumpster. Do not leave items on the ground. Do not leave items "someone may be able to use." You will be fined. We will prosecute non-resident dumpers through DeKalb County Judicial System.
The OP and OPII Board have prosecuted several cases of illegal dumping as well as collected numerous $500.00 fines from resident violators.
Front Porch Lights are Dusk to Dawn
There is no switch to turn the front porch light off. They are on a dusk to dawn timer. It is the homeowner's responsibility to change the lightbulbs when they burn out.
THE HOMEOWNER MUST MAINTAIN A WORKING LIGHTBULB IN THE FIXTURE.

There is only one place to put trash in the compactor, through the door. DO NOT THROW TRASH ON TOP OF THE COMPACTOR.

The OPII Board will issue noise violation fines to units that violate our noise/good neighbor policy.
“Continuous loud, unnecessary or unusual sounds or noises such as excessively loud music, fireworks, fighting, banging, jumping, screaming, running, riding bikes, trikes, or other outdoor riding toys inside, thumping, dogs barking or continued nuisances, which unreasonably annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others in the community, are prohibited.
After an initial warning, fines are issued at an escalating rate starting at $50 and increase in $50 increments, i.e. $50, 100, 150, 200, etc. Fines are to be paid within a 30 days. ”
In an effort to keep a peaceful, considerate community, residents should adhere to a 9:00PM - 9:00AM noise free zone. However, fines can be issued at any time for insolent noise violations.
Upper Units with Hardwood Floors
If a homeowner's hardwood floors contribute to excessive noise complaints from residents living below, the homeowner may be required to cover the hardwood floors with carpet. This includes creaking or worn hardwood/manmade material flooring and everyday footsteps, dropping of objects, or anything that unreasonably annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others in the community, are prohibited.

This is a multi-family community. We must make every effort to consider our neighbors. Each homeowner has a right to a peaceful, tranquil home environment. Normal multi-family community noises are to be expected. This policy is intended to address continuous, inconsiderate violations that affect quality of living. Be kind and considerate of your neighbors.
Window Air Units / Extreme Weather
You are required to maintain a working heating system and air conditioning unit in your unit.
You are required to maintain working heat system to prevent freezing pipes in the winter.
You are not permitted to use window units in place of a working air conditioning system

Front Porch / Back Porch /Common Areas
Free of Clutter, Trash and Debris
We advised the community in the last newsletter that we will be enforcing a clean front porch area. Items such as Non-patio type furniture (beds, couches, dining tables, end tables, etc.), appliances, storage items, grills, smokers, and/or trash are a safety violation and a fire hazard and can affect our insurance coverage.
We must be diligent about protecting our property. Over the next two months, the Board will perform visual inspections of all buildings and will issue warnings to those units in violation. You will have seven (7) days to resolve the violation before a fine of $50.00 will be assessed. Fines will increase with each week that the violation continues. If the Board has the items removed from the common area of your unit, the cost will be billed to your account.
Automatic/No Warning Fines:
- Trash on Front Porch $50.00
- Driving with Trash on car $50.00 (Camera or observations)
- Safety Violations (grills, smokers, propane burners, hot plates, open flame burners, electrical cooking appliances, refrigerators, freezers) $1,000.00
- Harassing, threatening or intimidating a board member $500.00

NO SEMI-TRUCK PARKING OR ALLOWED ON OP PROPERTY
No Semi-Truck Parking on property. Only in the case of a temporary moving truck or delivery, should there ever be a semi-truck on OPI or II Property. Violators will be towed away at the cost to the homeowner and a fine, not less than $500 against the homeowner/driver.
Semi-trucks damage the roadway with excessive weight causing cracks and potholes. The roadways in Orchard Park are private and OP residents are responsible for the cost of maintenance and repair.
Hitch trailers are not allowed to park in OPII.
Small trailers, attached to a small pick up truck are allowed for the purpose of moving or completing tasks for the OPII Board.
No Commercial Vehicles allowed to park on property overnight. All company logos must be covered. $50 per incident.
You are responsible for your doors and windows.
Windows must have white or off white facing curtains or blinds.
All homeowners are required to register their vehicles to their new address within 60 days of relocating. This is also state law.
All vehicles parked in OPII must have a parking permit or be parked in the visitor parking lots.
All permits must be requested by an Orchard Park II unit owner.
To receive parking permits, you must provide a photo-copy of the driver's license and a photo-copy of the registration for each driver and each vehicle. Those documents MUST show your Orchard Park II address and one must match the name of the owner of the property.
FAILURE TO REGISTER YOUR VEHICLE TO YOUR ORCHARD PARK II ADDRESS WILL RESULT IN A $50.00 FINE. Vehicles will be towed from the property.
In the state of Georgia you have 60 days to change your address after moving or relocating.

Go to: https://dekalbtax.org/address-changes for information for changing your registration. Parking permits are not issued to unauthorized renters.
Long term guests (guests staying longer than 3 days) must have a valid guest parking permit. Submit the make, model, color and tag of the visiting vehicle for a temporary permit to the OPII email and note "Request for Visitor Pass" in the subject line.
OP and OPII have a reciprocal parking/towing agreement.

No Auto Repairs Allowed
No auto repaired allowed on the OPII Property. Any repairs or maintenance that involve paint, oils, transmission fluid, etc. are subject to fines.
Any damage done to the parking lot will be billed to the unit owner.
If you receive a 48 Hour Tow Notice
If you receive a 48 Hour Tow Notice on your vehicle, you will have 48 hours to contact the OPII HOA Board and correct the violation. Contact the OPII Board at 678-323-4393 or orchardparkiihoa@gmail.com only, to correct the listed problem. After 48 hours with no contact from vehicle owner, vehicle will be towed without any further notice.
DO NOT CONTACT BOARD MEMBERS AT THEIR PERSONAL RESIDENCES. FINES INCREASE WITH EACH VIOLATION.
Some 48 hour tow notice reasons:

No OPII Parking Permit (You have not provided the proper documentation to receive a parking permit or you are a visitor parking in a non-visitor parking lot.)

Abandoned/Inoperable Vehicle (Inoperable vehicles are not allowed to park in OPII parking lots. No storage of vehicles allowed. All vehicles must be operable and registered to OPII address. )

Expired Tags (All vehicles must have a current registered tag. )

Parking in Restricted Area - (As noted. No semi-trucks allowed.)

Administrative Issue (Late or non-payments, renter privilege termination, accounts must be brought current before parking privileges are re-instated.)

No Handicapped Parking Permit. Immediate Tow plus an additional $500.00 fine.
SAFETY VIOLATIONS CARRY A NO WARNING $500.00 - $1,000.00 FINE.
No Fireworks Allowed.
Satellite Dishes
Fireworks pose a threat to the safety of the residents, vehicles and property.
Violators will be fined $1,000.00 on the first violation. Subsequent violations will results in higher fines and loss of community privileges.
